These Terms & Conditions govern the use of the Thabseki Bakery website and the purchase of products through our online store.
Thabseki Bakery is operated by Mohautse Group T/A Thabseki Bakery, located at 51 Carnarvon Street, Cathcart, Eastern Cape, 5310, South Africa.
By using this website or placing an order through our online store, you agree to these Terms & Conditions, together with our Privacy Policy and Refund, Returns & Cancellation Policy.
1. About Thabseki Bakery
Thabseki Bakery is a bakery business providing bread, buns, rolls, cakes, pastries and other bakery products to customers.
Our online store allows customers to view products, place orders and select available delivery or collection options.
2. Products and Product Information
We make reasonable efforts to ensure that product descriptions, photographs, prices and other information displayed on the website are accurate and up to date.
However, bakery products are handmade and may vary slightly in appearance, size, shape or decoration from photographs displayed on the website.
Product availability may change from time to time. A product displayed online does not necessarily guarantee that the product will remain available at the time an order is placed.
3. Prices
All prices displayed on the website are in South African Rand (ZAR).
Prices may change without prior notice. The price applicable to an order will be the price displayed at the time the order is placed, subject to any obvious pricing error.
If an obvious error occurs in the displayed price, we will contact the customer before processing the order and provide the customer with the available options.
4. Placing an Order
Customers may place orders through the online store by selecting the required products, quantities and available delivery or collection option and completing the checkout process.
Placing an order constitutes an offer by the customer to purchase the selected products.
An order is not necessarily accepted merely because the customer receives an automated acknowledgement or order confirmation.
We reserve the right to contact the customer if there is a problem with product availability, payment, delivery information or any other material aspect of the order.
5. Order Confirmation
After an order has been submitted, the customer may receive an electronic confirmation containing details of the order.
Customers should check the order information carefully and contact us as soon as possible if any information is incorrect.
6. Payment
Payment must be made using the payment methods made available through the website.
An order may not be processed until the required payment has been successfully received or authorised, unless another payment arrangement has been agreed with Thabseki Bakery.
We do not store customers’ full payment card details on our website where payment is processed by an external payment service provider.
7. Delivery
Our online store currently provides delivery options according to the delivery zones and methods displayed during checkout.
Delivery availability, delivery charges and estimated delivery arrangements may depend on the customer’s location and the delivery method selected.
For local Cathcart delivery, the customer must provide accurate delivery information, including the correct address and contact details.
We will make reasonable efforts to deliver orders within the agreed or communicated delivery period.
Delivery times may be affected by circumstances outside our reasonable control, including weather, traffic, equipment problems, power interruptions, supplier delays or unusually high order volumes.
8. Collection
Where collection is offered, customers may collect their orders from Thabseki Bakery at:
51 Carnarvon Street
Cathcart
Eastern Cape
5310
South Africa
Customers should only collect orders after receiving confirmation that the order is ready for collection.
9. Custom and Special Orders
Some bakery products may require advance preparation or special arrangements.
For customised cakes, special quantities or other products requiring advance preparation, we may require additional notice or payment arrangements.
The details applicable to a special order will be communicated to the customer before the order is confirmed.
10. Cancellations
Cancellation requests should be made as soon as possible after placing an order.
Because bakery products may be prepared specifically for an order and may be perishable, cancellation rights may depend on the stage of preparation and the nature of the product.
Nothing in these Terms & Conditions is intended to remove or restrict any cancellation or other consumer right provided by applicable South African law.
Please refer to our Refund, Returns & Cancellation Policy for further information.
11. Refunds and Returns
Refunds and returns are handled in accordance with our Refund, Returns & Cancellation Policy and applicable South African consumer-protection law.
Customers should retain their receipts, order confirmations and other proof of purchase.
Nothing in these Terms & Conditions is intended to exclude any consumer right that cannot lawfully be excluded.
12. Perishable Bakery Products
Many of our products are fresh or perishable bakery products.
Customers are responsible for storing products appropriately after collection or delivery and should follow any storage or consumption instructions provided with the product.
Where a product has a recommended consumption period, customers should take reasonable steps to consume or store the product within that period.
13. Allergens
Our bakery products may contain or come into contact with ingredients that can cause allergic reactions.
Depending on the product, ingredients may include, among others, wheat/gluten, milk, eggs, soy, nuts or other allergens.
Customers with food allergies or specific dietary requirements should contact Thabseki Bakery before placing an order so that we can provide available product information.
Although we take reasonable precautions, we cannot guarantee an allergen-free environment where different products are prepared.
14. Customer Information
Customers are responsible for providing accurate and complete information when placing an order.
This includes the customer’s name, telephone number, email address, delivery address and other information necessary to process the order.
We are not responsible for delays or failed deliveries caused by incorrect or incomplete information supplied by the customer.
15. Privacy
Personal information provided through the website will be handled in accordance with our Privacy Policy and applicable South African privacy legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).
We collect and process personal information only for legitimate business purposes connected with operating the website, processing orders, providing customer support, fulfilling deliveries and other purposes explained in our Privacy Policy.
16. Website Use
Customers must use the website lawfully and must not:

However, we do not guarantee that the website will always be available, uninterrupted, error-free or free from technical problems.
The website may occasionally be unavailable because of maintenance, updates, technical failures, hosting problems, internet interruptions or circumstances beyond our reasonable control.
18. Intellectual Property
Unless otherwise stated, content appearing on the Thabseki Bakery website, including our name, branding, photographs, text, graphics and other materials, belongs to or is used by Thabseki Bakery or the relevant rights holder.
Such material may not be reproduced, copied, modified or commercially exploited without appropriate permission.
19. Third-Party Services
Our website may use third-party services, including payment, hosting, delivery, analytics, communication or other technology providers.
Where a third party processes information or provides a service necessary for an online transaction, its own terms and privacy practices may also apply.
20. Limitation of Liability
Nothing in these Terms & Conditions is intended to exclude or limit any liability or consumer right that cannot lawfully be excluded or limited under South African law.
Subject to applicable law, Thabseki Bakery will not be responsible for losses caused solely by circumstances outside our reasonable control.
21. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our business, website, products, services or applicable legal requirements.
When we make material changes, we will update the “Last updated” date at the beginning of this page.
Customers are encouraged to review these Terms & Conditions periodically.
22. Applicable Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any dispute relating to the use of this website or an order placed through the website will be dealt with in accordance with applicable South African law and any applicable consumer-protection mechanisms.
